In any land transaction, the Certificate of Title is the single most important document. It is the legal proof of ownership. Understanding how to read and verify it is a critical skill for any investor.

Key Sections of a Ugandan Land Title

The Front Page:

  • Tenure Type: It will clearly state whether the land is Mailo, Freehold, or Leasehold.
  • Block and Plot Number: This is the unique identifier for your piece of land within the national land registry system. For example, 'Kyadondo Block 244 Plot 1234'. This is the information you use to conduct a search.
  • Registered Proprietor: This shows the name of the current legal owner. This name MUST match the seller's identification documents.

The Second Page (Encumbrance Page):

This is the most critical page for due diligence. It lists any claims against the land. Look for:

  • Mortgages: Is the land currently mortgaged to a bank? If so, the bank has a primary claim on it until the loan is cleared.
  • Caveats: A caveat is a legal notice lodged by someone who claims an interest in the land (e.g., a family member, a person who paid a deposit). A caveat prevents the owner from selling until the claim is resolved.
  • Easements: These are rights granted to others to use your land for a specific purpose, like a right of way for a path or utility lines.

Verification is Everything

Never trust the physical copy of the title alone. Forgeries are common. The only way to be sure is to take the Block and Plot number to the relevant Ministry of Lands Zonal Office and request a search. The official search report will show you the true, up-to-date status of the land, including the rightful owner and any encumbrances. This is a small fee that can save you from catastrophic loss.
